Does owning illegal music count for a violation?
I’ve heard that college students who download on campus or in dorms can be sued by the RIAA. But what if I own illegal music, but never download on campus or in dorms? Can they still report me?
Yes and no.
Downloading music that you didn’t pay for is illegal, regardless of where you download it. If the RIAA detects you downloading music, they can sue you, regardless of whether you were on campus.
The RIAA is convinced that the majority of downloading takes place on campuses, and so has concentrated their enforcement efforts there, as well as highly publicizing those efforts. Don’t be fooled into thinking that they are not looking for violators elsewhere, though.
The court cases, however, all seem to be based on the act of making copyrighted content available, that is uploading the content, not merely possessing it. So in short, if you were to stop downloading and seeding all illegal content, and you haven’t been caught yet, you’re probably OK.
And as to the second part of the question: I’ve seen reports verifying that some schools have the ability to see what content you have on your computer, but that information is available only to the school, and not to the RIAA. I’m not aware of any instances in which any action has been taken by a school based on content found this way, much less any cases where the school obtained that information and then passed it on to the RIAA for the purpose of having their students be sued.
So the only way to be 100% safe is to never to have downloaded illegal content, but if you take no further action on the content you have, I’d guess that you’re safe.
